Terms of Service
1. DEFINITIONS & INTERPRETATION
Unless the context otherwise requires, the following expressions shall have the meanings assigned below.
1.1 Company
Aiavantra Private Limited, on behalf of itself and its affiliates/group companies under the brand "Gowellit" (“Gowellit”), is the author and publisher of the internet resource www.gowellit.com and the mobile application “GoWellit” (together, “Website”).
1.2 Platform
"Platform" means every website, mobile application, web application, kiosk, AI Avatar interface, chatbot, voice assistant, API, software application, digital portal, wearable integration, smart device integration, SDK, cloud platform, dashboard and digital interface owned, licensed or operated by GoWellit.
1.3 User
"User" means any individual or organization accessing the Platform including but not limited to:

- • Doctors
- • Ayurvedic Physicians
- • Hospitals
- • Clinics
- • Dieticians
- • Yoga Trainers
- • Therapists
- • Wellness Experts
- • Laboratories
- • Pharmacies
- • Marketplace Sellers
- • Corporate Clients
- • Resort Partners
1.4 Registered User
A Registered User means any User who has successfully completed the registration process and created an authenticated GoWellit account.
1.5 AI Doctor Avatar
"AI Doctor Avatar" means an Artificial Intelligence powered digital representation of a licensed healthcare professional authorized by such healthcare professional to communicate using the doctor's approved digital likeness, voice, knowledge base and consultation protocols.
The AI Doctor Avatar is intended solely to:
- • understand patient concerns;
- • collect health information;
- • conduct AI-assisted preliminary assessment;
- • educate patients;
- • provide wellness information;
- • generate AI Assessment Reports;
- • facilitate efficient doctor consultations.
The AI Doctor Avatar shall not independently diagnose diseases or prescribe medicines unless expressly permitted by applicable law.
1.6 AI Assessment Report
An AI Assessment Report means an automatically generated digital report prepared using Artificial Intelligence based upon information voluntarily provided by the User.
The report may include:
- - Patient profile
- - Conversation summary
- - Presenting complaints
- - Lifestyle observations
- - Possible risk indicators
- - Preventive wellness recommendations
- - Suggested lifestyle improvements
- - Potential follow-up recommendations
The AI Assessment Report is informational only and shall not constitute a medical diagnosis or prescription.
1.7 Digital Prescription
A Digital Prescription means a prescription reviewed, approved and issued electronically by a licensed healthcare professional using GoWellit's digital prescription management system. Digital Prescriptions may include medicines, therapies, laboratory investigations, dietary recommendations, yoga protocols and follow-up instructions.
1.8 Digital Health Profile (DHP)
Digital Health Profile means the secure electronic repository maintained by GoWellit containing a User's authorized health records including but not limited to:
- - 3D visualization human body parts and organs
- - Visualization of health insights of specific health issue related to body part or organ.
- - Medical history
- - Consultation records
- - Digital prescriptions
- - Laboratory reports
- - Radiology reports
- - Vital signs
- - Allergies
- - Medication history
- - Therapy records
- - Organ health trends
- - Lifestyle history
- - Preventive health assessments
- - Wellness programs
The DHP is intended to facilitate continuity of care and personalized wellness management.
1.9 Healthcare Professional
Healthcare Professional means any doctor, Ayurvedic physician, consultant, therapist, dietician, yoga instructor or other qualified professional legally authorized to provide healthcare or wellness services under applicable law.
1.10 Marketplace
Marketplace means the online marketplace operated through GoWellit enabling Users to purchase or book products and services offered by GoWellit and/or third-party providers.
1.11 Smart Coins
Smart Coins mean promotional digital reward points issued by GoWellit under its customer engagement program.
Smart Coins:
- do not represent legal tender;
- are not electronic money;
- have no intrinsic monetary value;
- cannot ordinarily be exchanged for cash;
- may only be redeemed under the Smart Coin Policy.
1.12 RHIF (Red –Amber-Green Health Intelligence Framework)
RHIF means AI-generated wellness indicators (Red means critical situation, Amber means borderline and Green means healthy) which developed using information voluntarily provided by Users including symptoms, lifestyle, laboratory findings, health records and other authorized information.
Such indicators are intended solely to assist preventive healthcare and wellness monitoring.
1.13 Medical Emergency
Medical Emergency means any condition requiring immediate medical intervention including but not limited to:
- heart attack;
- stroke;
- difficulty breathing;
- major trauma;
- loss of consciousness;
- uncontrolled bleeding;
- severe allergic reaction;
- suicidal ideation;
- or any life-threatening condition.
1.14 Interpretation
Unless the context otherwise requires:
- words importing the singular include the plural and vice versa;
- references to statutes include amendments and successor legislation;
- headings are inserted for convenience only and shall not affect interpretation;
- references to one gender include all genders;
- references to writing include electronic communication.
2. ACCEPTANCE OF TERMS
By accessing, browsing, registering with or otherwise using the Platform, you expressly acknowledge and agree that:
- (a) you have read these Terms in their entirety;
- (b) you understand the legal rights and obligations contained herein;
- (c) you voluntarily agree to be legally bound by these Terms;
- (d) you consent to the collection and processing of your information as described in the Privacy Policy;
- (e) you understand that GoWellit's AI services are designed to support healthcare professionals and are not intended to replace professional medical judgment;
- (f) you agree to comply with all applicable laws while using the Platform;
- (g) you acknowledge that continued use of the Platform following publication of revised Terms constitutes acceptance of those revised Terms.
If you do not agree with these Terms, you must immediately discontinue use of the Platform.
3. ELIGIBILITY
To use the Platform, you represent and warrant that:
- 1. You are at least eighteen (18) years of age or otherwise possess legal capacity to enter into a binding agreement under applicable law.
- 2. If you are below eighteen (18) years of age, your account shall be created and operated only by a parent or lawful guardian acting on your behalf.
- 3. The information provided during registration is accurate, complete and current.
- 4. You shall promptly update any information that becomes inaccurate or outdated.
- 5. You shall not impersonate another person or create accounts using false identities.
- 6. You shall use the Platform only for lawful purposes.
- 7. You shall not use the Platform if prohibited under applicable laws.
GoWellit reserves the right to suspend or terminate any account where it reasonably believes that the eligibility requirements under these Terms are not satisfied.
4. USER REGISTRATION
4.1 Account Creation
To access certain features of the Platform, Users must create a GoWellit Account.
During registration, the User may be required to provide:
- • Full Name
- • Mobile Number
- • Email Address
- • Date of Birth
- • Gender
- • Government-issued Identification (where applicable)
- • Residential Address
- • Emergency Contact Details
- • Health History
- • Consent Preferences
- • Language Preferences
- • Communication Preferences
- • Any other information reasonably required by GoWellit to provide its Services.
GoWellit reserves the right to introduce additional identity verification procedures at any time in compliance with applicable laws or internal security policies.
4.2 Accuracy of Information
The User represents and warrants that:
- • all information submitted is true, accurate and complete;
- • no misleading, fraudulent or fabricated information has been provided;
- • information shall be updated whenever changes occur.
GoWellit shall not be responsible for any consequences arising from inaccurate or incomplete information supplied by the User.
4.3 One Account Policy
Unless expressly authorized by GoWellit:
- • each individual may maintain only one personal account;
- • duplicate, fake or anonymous accounts are prohibited;
- • business accounts may only be created through approved onboarding procedures.
GoWellit reserves the right to merge, suspend or permanently delete duplicate accounts.
4.4 Identity Verification
To protect patient safety and prevent fraud, GoWellit may require Users to complete identity verification through one or more of the following:
- • Mobile OTP verification
- • Email verification
- • Government-issued identity documents
- • Facial verification
- • Video verification
- • Professional licence verification (for healthcare professionals)
- • Digital signatures
- • Any other legally permissible verification mechanism.
Failure to complete verification may restrict access to certain Platform features.
4.5 Healthcare Professional Registration
Doctors and other healthcare professionals registering on the Platform agree that:
- • all professional qualifications submitted are authentic;
- • registrations remain valid throughout the duration of Platform use;
- • licences shall be renewed as required;
- • only legally authorized healthcare services shall be offered.
GoWellit reserves the right to verify qualifications with regulatory authorities. Submission of credentials does not automatically guarantee onboarding onto the Platform.
5. ACCOUNT SECURITY
5.1 User Responsibility
The User is solely responsible for:
- • maintaining confidentiality of login credentials;
- • preventing unauthorized access to their account;
- • protecting registered devices;
- • safeguarding passwords;
- • maintaining updated contact information.
5.2 Unauthorized Access
Users shall immediately notify GoWellit if they become aware of:
- • unauthorized account access;
- • suspected hacking;
- • identity theft;
- • stolen mobile devices;
- • unauthorized transactions;
- • suspicious Smart Coin activity;
- • unauthorized AI Avatar interactions.
Until such notification is received, GoWellit shall not be liable for activities conducted through the User's authenticated account.
5.3 Password Security
Users agree:
- • not to disclose passwords;
- • not to share OTPs;
- • not to share authentication tokens;
- • not to allow unauthorized persons to operate their account.
GoWellit employees will never request passwords through email, telephone or messaging applications.
5.4 Multi-Factor Authentication
GoWellit may introduce:
- • biometric authentication;
- • device authentication;
- • facial recognition;
- • hardware authentication;
- • passkeys;
- • multi-factor authentication.
Users may be required to complete these procedures before accessing sensitive healthcare information.
6. GO WELLIT PLATFORM OVERVIEW
6.1 Nature of Platform
GoWellit is an integrated AI-enabled digital healthcare and wellness ecosystem. The Platform combines Artificial Intelligence with licensed healthcare professionals to improve accessibility, continuity and personalization of healthcare services. GoWellit does not replace licensed healthcare professionals. Rather, it provides digital tools that enhance healthcare delivery.
6.2 Core Services
Subject to applicable law, the Platform may provide one or more of the following services:
A. AI Doctor Avatar
GoWellit enables licensed doctors to create AI-powered Digital Avatars that resemble the doctor's appearance and communicate using the doctor's authorized voice.
The AI Doctor Avatar functions as a digital representative of the healthcare professional and assists in:
- • collecting patient information;
- • understanding symptoms;
- • conducting structured conversations;
- • generating AI Assessment Reports;
- • improving consultation efficiency;
- • educating patients regarding wellness.
The AI Avatar does not independently diagnose diseases or prescribe medicines.
B. AI Assessment Report
Following interaction with the AI Avatar, the Platform may generate an AI Assessment Report.
The report may include:
- • patient summary;
- • symptom history;
- • health observations;
- • wellness recommendations;
- • lifestyle recommendations;
- • preventive care suggestions;
- • consultation summary;
- • follow-up recommendations.
The AI Assessment Report is intended solely to assist healthcare professionals and patients. It shall not constitute a medical diagnosis.
C. Doctor Review Workflow
Where applicable:
- 1. the patient interacts with the AI Doctor Avatar;
- 2. the AI Assessment Report is generated;
- 3. the licensed doctor or authorized clinical team reviews the report;
- 4. additional consultation may occur;
- 5. the doctor independently exercises professional judgment;
- 6. where clinically appropriate, the doctor issues a Digital Prescription.
The doctor retains sole responsibility for all clinical decisions.
D. Digital Health Profile
Users may build and maintain a lifelong Digital Health Profile (DHP).
The DHP may contain:
- • prescriptions;
- • consultation records;
- • laboratory reports;
- • radiology reports;
- • allergies;
- • medications;
- • vaccination history;
- • lifestyle information;
- • wellness history;
- • organ health indicators;
- • chronic disease history;
- • therapy records.
The DHP enables continuity of care across healthcare providers.
E. Appointment Booking
The Platform enables Users to schedule appointments for:
- • online/offline consultations;
- • clinic consultations;
- • hospital visits;
- • dietician appointments;
- • yoga sessions;
- • therapy sessions;
- • Panchakarma treatments;
- • wellness programs.
Appointment availability depends upon healthcare provider schedules.
F. Diagnostics
Users may:
- • book pathology investigations;
- • schedule laboratory collections;
- • book radiology examinations;
- • receive reports electronically;
- • integrate reports into their DHP.
Diagnostic services are performed by authorized third-party providers unless otherwise specified.
G. Pharmacy
Users may purchase:
- • Ayurvedic medicines;
- • herbal supplements;
- • nutraceuticals;
- • wellness products;
- • prescribed medicines where legally permitted.
Availability varies by jurisdiction.
H. Marketplace
The Marketplace enables Users to purchase:
- • healthcare products;
- • wellness products;
- • therapies;
- • consultations;
- • health packages;
- • yoga services;
- • wellness retreats;
- • laboratory services.
Third-party sellers remain responsible for their own products.
I. Smart Coin Ecosystem
GoWellit may reward Users through Smart Coins for:
- • AI Avatar interactions;
- • wellness activities;
- • referrals;
- • purchases;
- • campaigns;
- • health challenges;
- • preventive health programs.
Smart Coins may be redeemed only in accordance with the Smart Coin Policy.
7. PLATFORM AVAILABILITY
GoWellit continuously develops and improves its Platform.
Accordingly:
- • new services may be introduced;
- • existing services may be modified;
- • features may be discontinued;
- • AI models may be upgraded;
- • interfaces may change;
- • pricing may be revised.
Nothing contained in these Terms shall obligate GoWellit to continue offering any specific feature indefinitely.
8. SERVICE LIMITATIONS
GoWellit provides a technology platform that facilitates healthcare delivery.
Accordingly:
- • GoWellit does not guarantee treatment outcomes;
- • availability of healthcare professionals cannot be guaranteed;
- • appointment times are estimates;
- • medicine availability depends upon inventory;
- • laboratory turnaround depends upon partner laboratories;
- • internet connectivity may affect Platform performance.
9. RIGHT TO MODIFY SERVICES
GoWellit reserves the right to:
- • introduce new products;
- • discontinue products;
- • update AI models;
- • improve algorithms;
- • change subscription plans;
- • revise Smart Coin policies;
- • modify Marketplace offerings;
- • add healthcare partners;
- • remove healthcare partners;
- • improve user experience.
Such modifications shall become effective upon publication unless otherwise required by law.
10. ACKNOWLEDGEMENT
By continuing to use the Platform, the User acknowledges that:
- • GoWellit is an AI-assisted healthcare platform;
- • AI is intended to assist, not replace, healthcare professionals;
- • healthcare decisions remain the responsibility of licensed practitioners;
- • Platform features may evolve continuously;
- • acceptance of these Terms is a condition for continued use of the Platform.
11. AI DOCTOR AVATAR SERVICES
11.1 Nature of the AI Doctor Avatar
GoWellit provides an Artificial Intelligence-enabled Digital Doctor Avatar ("AI Doctor Avatar") as an advanced patient engagement and healthcare assistance technology.
Each AI Doctor Avatar is created only after obtaining appropriate authorization from the respective licensed healthcare professional and is intended to function as the doctor's digital representative within the GoWellit Platform.
The AI Doctor Avatar may utilize the doctor's approved digital likeness, voice, professional profile, knowledge base, consultation methodology, and clinical preferences solely for the purpose of delivering AI-assisted healthcare interactions.
The AI Doctor Avatar is designed to enhance patient accessibility and improve healthcare efficiency. It is not intended to replace the professional judgment, ethical obligations, or legal responsibilities of a licensed healthcare professional.
11.2 Purpose of the AI Doctor Avatar
The AI Doctor Avatar may assist Users by:
- • collecting health-related information voluntarily provided by the User;
- • understanding symptoms through structured conversational interactions;
- • recording medical history;
- • documenting lifestyle habits;
- • identifying risk indicators based on available information;
- • generating AI Assessment Reports;
- • educating Users regarding preventive healthcare;
- • suggesting wellness practices;
- • recommending that Users seek professional medical consultation where appropriate;
- • facilitating appointment scheduling;
- • enabling continuity of care.
The AI Doctor Avatar shall always operate within the scope of services authorized by GoWellit and applicable law.
11.3 Limitations of the AI Doctor Avatar
The User expressly acknowledges that the AI Doctor Avatar:
- • is an Artificial Intelligence system;
- • does not possess human consciousness or independent clinical judgment;
- • may generate incorrect, incomplete, outdated or inaccurate responses;
- • cannot perform physical examinations;
- • cannot independently interpret physical findings;
- • cannot independently establish a definitive medical diagnosis;
- • cannot independently prescribe medicines where prohibited by law;
- • cannot guarantee medical outcomes;
- • should not be relied upon during medical emergencies.
11.4 Continuous Learning
GoWellit may continuously improve AI Doctor Avatars through:
- • software updates;
- • model improvements;
- • clinical validation;
- • quality assurance processes;
- • authorized feedback mechanisms;
- • knowledge base enhancements.
Such improvements may modify the manner in which AI responses are generated without prior notice.
12. AI-ASSISTED PATIENT ASSESSMENT
12.1 User Interaction
Users may voluntarily interact with an AI Doctor Avatar through:
- • voice conversations;
- • text chat;
- • images;
- • uploaded medical reports;
- • questionnaires;
- • symptom checkers;
- • wearable integrations;
- • other approved digital interfaces.
12.2 Information Provided by Users
Users acknowledge that AI-generated outputs depend entirely upon the accuracy, completeness and timeliness of information voluntarily provided.
GoWellit shall not be responsible for any AI-generated recommendation resulting from:
- • incorrect information;
- • omitted symptoms;
- • false medical history;
- • inaccurate laboratory reports;
- • outdated medications;
- • incomplete lifestyle information.
12.3 AI Assessment Methodology
The AI Doctor Avatar may analyse:
- • presenting complaints;
- • medical history;
- • family history;
- • lifestyle;
- • dietary habits;
- • sleep patterns;
- • stress indicators;
- • medications;
- • laboratory findings;
- • wearable device information;
- • previous consultations;
- • Digital Health Profile records.
The resulting assessment represents an AI-generated interpretation of available information and shall not constitute a clinical diagnosis.
13. AI ASSESSMENT REPORTS
13.1 Generation
Following completion of an AI interaction, the Platform may automatically generate an AI Assessment Report.
The report may include:
- • Patient Identification;
- • Conversation Summary;
- • Presenting Complaints;
- • Medical History Summary;
- • Lifestyle Assessment;
- • Wellness Indicators;
- • Organ Health Insights;
- • Preventive Recommendations;
- • Suggested Lifestyle Changes;
- • Suggested Follow-up;
- • Recommended Consultation Pathway.
13.2 Nature of Report
The User expressly acknowledges that the AI Assessment Report:
- • is computer generated;
- • is informational;
- • is educational;
- • is intended to support healthcare professionals;
- • does not constitute a diagnosis;
- • does not constitute medical advice;
- • does not constitute a prescription;
- • does not establish a doctor-patient relationship by itself.
13.3 Report Availability
AI Assessment Reports may be made available through:
- • GoWellit Mobile Application;
- • Website;
- • Email;
- • Secure Digital Link;
- • Patient Dashboard;
- • Authorized Healthcare Professional Dashboard.
13.4 Retention
AI Assessment Reports may be securely stored within the User's Digital Health Profile for continuity of care, unless otherwise prohibited by law or deleted pursuant to applicable privacy regulations.
14. DOCTOR REVIEW PROCESS
14.1 Human Clinical Oversight
GoWellit follows a Human-in-the-Loop clinical model.
Where Digital Prescription services are offered, every prescription requiring professional medical authorization shall be independently reviewed by a licensed healthcare professional. The healthcare professional shall exercise independent clinical judgment before issuing any prescription or treatment recommendation.
14.2 Professional Independence
Nothing contained within the AI Assessment Report shall obligate a healthcare professional to:
- • accept the AI findings;
- • issue any prescription;
- • recommend any medicine;
- • recommend any therapy;
- • recommend any laboratory investigation.
The healthcare professional retains complete clinical independence.
14.3 Additional Consultation
A healthcare professional may:
- • request additional information;
- • conduct video consultation;
- • conduct telephone consultation;
- • require in-person examination;
- • request laboratory investigations;
- • refuse treatment where clinically appropriate.
15. DIGITAL PRESCRIPTION WORKFLOW
15.1 Prescription Generation
Where legally permitted, licensed healthcare professionals may issue Digital Prescriptions after:
- • reviewing the AI Assessment Report;
- • evaluating patient history;
- • interacting with the patient where required;
- • exercising independent clinical judgment.
15.2 Prescription Content
Digital Prescriptions may include:
- • Medicines;
- • Dosage Instructions;
- • Lifestyle Recommendations;
- • Dietary Advice;
- • Yoga Recommendations;
- • Panchakarma Recommendations;
- • Laboratory Investigations;
- • Radiology Tests;
- • Follow-up Schedule;
- • Specialist Referrals.
15.3 Delivery
Digital Prescriptions may be delivered through:
- • GoWellit Mobile App;
- • Patient Dashboard;
- • Email;
- • SMS;
- • Secure Download Link.
15.4 No Automatic Prescription
The User acknowledges that:
- • completion of an AI interaction does not guarantee issuance of a prescription;
- • doctors may decline to prescribe medicines;
- • doctors may require additional consultation;
- • doctors may recommend emergency care;
- • doctors may refuse treatment where clinically necessary.
16. USER ACKNOWLEDGEMENTS REGARDING AI
The User expressly acknowledges and agrees that:
- 1. Artificial Intelligence is a support technology.
- 2. AI-generated recommendations are probabilistic and not definitive.
- 3. AI outputs may occasionally contain errors.
- 4. AI may misunderstand User inputs.
- 5. Internet connectivity may affect AI performance.
- 6. Healthcare decisions should always involve licensed professionals where appropriate.
- 7. Emergency conditions require immediate medical attention outside the Platform.
- 8. GoWellit makes no warranty that AI outputs will always be accurate, complete or suitable for every User.
17. CLINICAL RESPONSIBILITY
The User acknowledges that:
- • AI Doctor Avatars do not practice medicine independently.
- • Licensed healthcare professionals remain solely responsible for diagnoses, prescriptions and treatment decisions.
- • Users remain responsible for providing truthful and complete information.
- • GoWellit provides technology infrastructure facilitating healthcare delivery and does not replace professional medical judgment.
18. NO EMERGENCY USE
If a User experiences:
- • chest pain;
- • severe bleeding;
- • difficulty breathing;
- • stroke symptoms;
- • loss of consciousness;
- • seizures;
- • severe allergic reactions;
- • suicidal thoughts;
- • or any life-threatening medical condition,
the User must immediately contact local emergency medical services or proceed to the nearest hospital.
GoWellit, its AI Doctor Avatars, healthcare professionals, employees, affiliates and technology partners shall not be liable for delays arising from the use of the Platform during a medical emergency.
19. DIGITAL HEALTH PROFILE (DHP)
19.1 Nature of the Digital Health Profile
The GoWellit Digital Health Profile ("DHP") is a secure electronic health record maintained by the Platform to enable Users to organize, manage and access their personal health information in one centralized location. The DHP is designed to support preventive healthcare, continuity of care, personalized wellness management and informed clinical decision-making. The DHP does not replace official medical records maintained by hospitals or healthcare providers but serves as a patient-controlled digital repository.
19.2 Contents of the DHP
Subject to applicable laws and User consent, the DHP may include, but is not limited to:
- • Personal Health Information;
- • Demographic Details;
- • Medical History;
- • Family Medical History;
- • Allergies;
- • Chronic Medical Conditions;
- • Medication History;
- • Vaccination Records;
- • Consultation Notes;
- • AI Assessment Reports;
- • Digital Prescriptions;
- • Laboratory Reports;
- • Radiology Reports;
- • Vital Signs;
- • Organ Health Indicators;
- • Lifestyle Assessments;
- • Nutritional Assessments;
- • Fitness Records;
- • Yoga Programs;
- • Panchakarma Records;
- • Wellness Programs;
- • Health Goals;
- • Progress Tracking;
- • Follow-up Recommendations.
GoWellit reserves the right to expand the categories of information maintained within the DHP to improve healthcare delivery and user experience.
19.3 Ownership of Health Data
The User retains ownership of their Personal Health Information uploaded to or generated through the Platform, subject to applicable law.
By using the Platform, the User grants GoWellit a limited, non-exclusive, revocable license to collect, store, process, analyze, transmit, and display such information solely for:
- • providing Platform services;
- • facilitating healthcare delivery;
- • generating AI assessments;
- • maintaining the DHP;
- • enabling consultations;
- • improving service quality;
- • complying with legal obligations.
Nothing in these Terms transfers ownership of the User's Personal Health Information to GoWellit.
19.4 Accuracy of Records
The User is responsible for ensuring that information uploaded to the DHP is accurate and current.
GoWellit shall not be responsible for any medical or other consequences arising from inaccurate, incomplete, outdated, or misleading information provided by the User or any third party.
19.5 Access and Sharing
The User may authorize access to their DHP by:
- • Licensed Healthcare Professionals;
- • Hospitals;
- • Clinics;
- • Diagnostic Laboratories;
- • Pharmacies;
- • Caregivers;
- • Family Members;

20.3 Rescheduling and Cancellation

GoWellit reserves the right to levy cancellation or rescheduling charges where disclosed in advance.
21. TELECONSULTATION SERVICES
21.1 Nature of Teleconsultation
GoWellit facilitates remote consultations between Users and licensed healthcare professionals through secure digital communication technologies.
Teleconsultations may be conducted using:
- • Video Calls;
- • Audio Calls;
- • Secure Messaging;
- • AI-Assisted Consultation Workflows.
The availability of teleconsultation services is subject to applicable law and regulatory requirements.
21.2 Professional Independence
Healthcare professionals retain complete discretion regarding:
- • diagnosis;
- • investigations;
- • treatment;
- • referrals;
- • prescriptions;
- • follow-up recommendations.
Nothing generated by the AI Doctor Avatar shall compel or influence a healthcare professional's independent clinical judgment.
21.3 Limitations
Teleconsultations may not be appropriate for all medical conditions.
Healthcare professionals may recommend:
- • physical examination;
- • hospital admission;
- • emergency treatment;
- • laboratory investigations;
- • specialist referral.
Users agree to comply with such recommendations where clinically appropriate.
22. DIAGNOSTIC SERVICES
22.1 Diagnostic Booking
The Platform may facilitate booking of diagnostic services, including:
- • Pathology Tests;
- • Blood Tests;
- • Urine Tests;
- • Imaging Services;
- • Radiology;

Diagnostic services may be provided by GoWellit or by authorized third-party laboratories and imaging centers.

GoWellit does not modify or validate laboratory findings.
22.3 Diagnostic Accuracy
The accuracy of diagnostic results remains the responsibility of the respective laboratory or imaging provider. GoWellit shall not be responsible for diagnostic errors committed by third-party providers.

31. REFUNDS AND CANCELLATIONS

Users shall not:

Users warrant that uploaded content:

- • does not infringe third-party rights;
- • is not defamatory;
- • is not unlawful;
- • is free from malicious code.
32.4 Community Standards
Users shall interact respectfully with:

- • healthcare professionals;
- • customer support personnel;
- • Marketplace sellers;
- • other Users.
GoWellit may suspend Users engaging in abusive or threatening conduct.
33. SUSPENSION AND TERMINATION
33.1 Suspension
GoWellit may temporarily suspend access where it reasonably believes that:
- • these Terms have been violated;
- • fraud has occurred;
- • payment disputes exist;
- • cybersecurity risks exist;
- • unlawful activity is suspected;
- • regulatory obligations require suspension.
33.2 Termination
GoWellit may permanently terminate an account where:
- • repeated violations occur;
- • fraudulent conduct is established;
- • criminal misuse is detected;
- • Platform security is threatened.
Termination shall not affect accrued rights or obligations.
33.3 Effect of Termination
Upon termination:
- • access to the Platform may cease;

Communications may be delivered through:

35. INTELLECTUAL PROPERTY RIGHTS

Unless expressly stated otherwise, all rights, title and interest in and to the Platform are and shall remain the exclusive property of GoWellit and its licensors.

- • Logos;
- • Trademarks;
- • Trade Dress;
- • Domain Names;
- • Documentation;
- • Reports;
- • Educational Materials;
- • Marketing Content;
- • Audio;
- • Video;
- • Designs;
- • Know-how;
- • Trade Secrets;
- • Confidential Information.
Nothing contained in these Terms transfers any intellectual property rights to the User.
35.2 Limited License
Subject to compliance with these Terms, GoWellit grants the User a limited, revocable, non-exclusive, non-transferable, non-sublicensable license to access and use the Platform solely for its intended purposes.
This license does not permit the User to:

- • reproduce;
- • distribute;
- • modify;
- • translate;
- • reverse engineer;
- • decompile;
- • disassemble;
- • create derivative works;
- • commercially exploit;
- • license;
- • sell;
- • rent;
- • lease;

any portion of the Platform without prior written consent.
35.3 AI Doctor Avatar Rights
The digital representation of a healthcare professional, including the Avatar's:
- • appearance;
- • facial characteristics;
- • expressions;
- • synthesized voice;
- • conversation style;
- • interaction flows;
- • training datasets;
- • clinical workflows,
is protected by intellectual property rights and contractual arrangements.
Users shall not:
- • copy the Avatar;
- • clone the Avatar;
- • train competing AI systems using the Avatar;
- • record interactions for commercial use;
- • reproduce the Avatar on another platform.
35.4 Feedback
Any suggestions, recommendations, ideas or feedback voluntarily provided by Users regarding the Platform may be used by GoWellit without restriction or obligation to provide compensation.
36. PRIVACY & DATA PROTECTION
36.1 Privacy Policy
Collection, use, storage, disclosure and processing of Personal Information shall be governed by the GoWellit Privacy Policy, which forms an integral part of these Terms.
36.2 User Consent
By using the Platform, the User expressly consents to the collection and processing of information necessary to:
- • provide healthcare services;
- • generate AI Assessment Reports;
- • maintain Digital Health Profiles;
- • facilitate consultations;
- • process payments;
- • improve Platform functionality;
- • comply with legal obligations.
36.3 Security Measures
GoWellit implements commercially reasonable administrative, technical and organizational safeguards designed to protect User information.
However, no digital system is completely secure. Accordingly, GoWellit cannot guarantee absolute security against unauthorized access, cyberattacks, malware, or other security incidents.
36.4 Cross-Border Data Transfers
Where required for service delivery, User information may be processed or stored in jurisdictions outside the User's country of residence, subject to applicable data protection laws and appropriate safeguards.
37. CONSENT FOR ARTIFICIAL INTELLIGENCE PROCESSING
The User expressly authorizes GoWellit to process health information using Artificial Intelligence for purposes including:
- • AI symptom assessment;
- • Digital Health Profile generation;
- • Organ Health Index calculation;
- • preventive healthcare recommendations;
- • wellness personalization;
- • healthcare workflow automation;
- • clinical decision support;
- • quality assurance.
Such processing shall not replace professional medical judgment.
38. AI MODEL IMPROVEMENT
To improve Platform quality, GoWellit may use de-identified, anonymized or aggregated information for:
- • algorithm improvement;
- • AI validation;
- • statistical analysis;
- • research;
- • quality assurance;
- • system performance monitoring;
- • clinical workflow optimization.
Personally identifiable information shall not be used for AI training without appropriate legal basis or User consent where required by applicable law.
39. THIRD-PARTY SERVICES
The Platform may integrate with:

GoWellit is not responsible for the independent acts, omissions or policies of such third parties. Users may be subject to the terms and privacy policies of those third parties.

40.1 General Disclaimer
The Platform is provided on an "AS IS" and "AS AVAILABLE" basis.
To the fullest extent permitted by law, GoWellit disclaims all warranties, whether express, implied or statutory, including warranties relating to:
- • merchantability;
- • fitness for a particular purpose;
- • uninterrupted availability;
- • accuracy;
- • reliability;
- • non-infringement.
40.2 Healthcare Disclaimer
GoWellit does not guarantee:
- • successful treatment;
- • recovery;
- • cure;
- • prevention of disease;
- • suitability of any medicine;
- • suitability of any wellness program.
Medical outcomes depend upon numerous factors beyond the Platform's control.
40.3 AI Disclaimer
Artificial Intelligence generates probabilistic outputs.
Accordingly:
- • AI responses may be inaccurate;
- • AI may misunderstand User input;
- • AI recommendations may not apply to every User;
- • AI should not be relied upon as the sole basis for healthcare decisions.
41. LIMITATION OF LIABILITY
To the maximum extent permitted by law:
GoWellit, its directors, officers, employees, affiliates, licensors, technology providers and partners shall not be liable for any:
- • indirect damages;
- • incidental damages;
- • consequential damages;
- • punitive damages;
- • exemplary damages;
- • loss of profits;
- • loss of revenue;
- • loss of goodwill;
- • loss of data;
- • business interruption;
- • medical complications arising from inaccurate User information;
- • acts or omissions of healthcare professionals;
- • acts or omissions of third-party providers.
Where liability cannot be excluded by law, GoWellit's aggregate liability shall not exceed the total amount actually paid by the User for the specific service giving rise to the claim during the preceding twelve (12) months.
Nothing in these Terms limits liability that cannot lawfully be excluded under applicable law.
42. INDEMNIFICATION
The User agrees to indemnify, defend and hold harmless GoWellit, its affiliates, directors, employees, healthcare partners and licensors from and against any claims, liabilities, damages, losses, costs and expenses arising out of or relating to:
- • violation of these Terms;
- • misuse of the Platform;
- • fraudulent conduct;
- • infringement of third-party rights;
- • unlawful content uploaded by the User;
- • breach of applicable laws.
43. FORCE MAJEURE
GoWellit shall not be liable for any delay or failure in performance caused by events beyond its reasonable control, including:
- • natural disasters;
- • epidemics;
- • pandemics;
- • war;
- • terrorism;
- • civil unrest;
- • cyberattacks;
- • internet failures;
- • governmental actions;
- • power outages;
- • labour disputes;
- • failures of third-party infrastructure.
44. GOVERNING LAW
These Terms shall be governed by and construed in accordance with the laws of the Republic of India, without regard to conflict of law principles. Where GoWellit operates in other jurisdictions, mandatory local consumer protection or healthcare laws shall apply to the extent required.
45. DISPUTE RESOLUTION
45.1 Good Faith Negotiation
The parties shall first attempt to resolve any dispute through good faith negotiations.
45.2 Arbitration
If a dispute is not resolved within thirty (30) days, it shall be referred to arbitration in accordance with the Arbitration and Conciliation Act, 1996, as amended.
- • Seat of Arbitration: Faridabad, Haryana, India (unless otherwise agreed)
- • Language: English
- • Tribunal: Sole arbitrator appointed by mutual agreement, or in accordance with applicable law if mutual agreement is not reached.
The arbitral award shall be final and binding.
45.3 Jurisdiction
Subject to the arbitration clause above, courts having jurisdiction over Faridabad, Haryana, India shall have exclusive jurisdiction for matters requiring judicial intervention.
46. REGULATORY COMPLIANCE
Users acknowledge that GoWellit endeavors to operate in compliance with applicable laws and regulations, including, where relevant:
- • Information Technology Act, 2000;
- • Digital Personal Data Protection Act, 2023;
- • Consumer Protection Act, 2019;
- • Drugs and Cosmetics Act, 1940;
- • Telemedicine Practice Guidelines (as applicable);
- • Applicable AYUSH regulations;
- • Medical Council and professional regulatory requirements;
- • Other healthcare, privacy, e-commerce, and consumer laws applicable in the jurisdictions where services are offered.
Nothing in these Terms authorizes any activity prohibited by applicable law.
47. AMENDMENTS
GoWellit may revise these Terms from time to time.
Material changes will be notified through reasonable means, including publication on the Platform.
Continued use of the Platform after the effective date of revised Terms constitutes acceptance of the revised Terms.
48. SEVERABILITY
If any provision of these Terms is held invalid, illegal or unenforceable, the remaining provisions shall remain in full force and effect.
49. WAIVER
Failure by GoWellit to enforce any provision shall not constitute a waiver of its rights. Any waiver shall be effective only if made in writing by an authorized representative of GoWellit.
50. ENTIRE AGREEMENT
These Terms, together with the Privacy Policy, Consent Forms, applicable Service-Specific Terms, and any policies expressly incorporated by reference, constitute the entire agreement between the User and GoWellit regarding use of the Platform and supersede all prior understandings relating to the subject matter.
